What is an option agreement?An option agreement is a contract that gives us the right to buy your land within a set time, usually after planning permission is granted. You stay the legal owner, and there’s no pressure to sell unless the conditions are met.

How long will the council take to decide on planning permission?Usually between 12 and 16 weeks, but this can vary depending on where you live and the complexity of the project

If I sell my garden and decide to split the title, how would it affect my house’s value?Your house’s value stays based on its size and condition. Splitting the title might slightly affect the desirability of the property — for example, for a homeowner looking for a large garden — but prices are generally determined by total hardstanding and location and would be in line with the market rate.

Will the offer price be agreed before signing the option agreement?Yes! We’ll agree on the offer price upfront, so you know exactly what to expect before signing anything.

How long does the option agreement last?Typically, it lasts 12 months, with a possible 6-month extension if needed — especially if we need to resubmit planning applications or deal with unexpected delays.

Do I need a solicitor?Yes, you’ll need a solicitor familiar with option agreements and property sales.

How much will it cost me?We pay for all planning costs and your legal fees up to £2,500 + VAT.

Will I have to pay Capital Gains Tax?If the property has been your main or only home during ownership, you usually won’t have to pay Capital Gains Tax. Still, it’s a good idea to chat with a Capital Gains Tax expert if you’re unsure.

Can I get a cash or outright purchase?Usually, we don’t do cash purchases. Planning can be tricky, and we prefer the option agreement route so we can handle the planning costs and risks ourselves.
